In the current 2026 landscape, the protection of intellectual property rights has become inseparable from the rule of law in Mexico. However, the most recent study by the Mexican Institute of Industrial Property (IMPI) reveals a challenging outlook: 148 notorious piracy markets have been identified across 30 federal entities, located in 61 municipalities and boroughs. These spaces are not merely points of sale, but centers of economic erosion that directly impact Mexico’s formal economic structure.
Piracy in Mexico has moved beyond basic informality, embedding itself within fixed establishments: 68% of these markets operate within entire commercial premises. This normalization of counterfeit product consumption generates critical consequences:
• Decline in sales: 67% of the identified markets report a direct drop in sales for local formal businesses.
• Tax evasion: 60% of these points of sale engage in tax evasion, reducing the government’s capacity to invest in infrastructure and public services.
• Investment deterrence: 13% of authorities report decreased investment in their regions due to unfair competition.
One of the most alarming findings is the loss of employment opportunities. The study indicates that the operation of these markets results in a 24% decrease in formal employment. By purchasing products without traceability, consumers indirectly finance the loss of income for thousands of families who depend on businesses that comply with legal obligations.
Piracy is not a “victimless” crime. In 15% of these markets, related offenses such as theft, altercations, fraud, and corruption have been reported. Additionally, there is a tangible public health risk: 6% of the markets report health issues among consumers, including skin conditions resulting from counterfeit cosmetics or medications.
At the international level, the OECD has indicated that trade in counterfeit goods accounts for up to 2.5% of global trade (OECD/EUIPO, 2021). In Mexico, initiatives such as “Operation Cleanup” have resulted in the seizure of more than 7 million units of counterfeit goods, valued at over 935 million pesos. Nevertheless, the definitive solution begins with the legal protection of innovation.
